نظام الكفالة العنصري يعرّض السوريين/ات للاستغلال (1)

يدخل نظام الكفالة اللاجئين/ات السوريين/ات، في سياق سعيهم/ن إلى قوننة وجودهم/ن على الأراضي اللبنانية، في دائرة رهيبة من الاستغلال والمهانة. عند محاولتهم/ن تسوية أوضاعهم/ن، لا حدّ لما يمكن أن يواجهوه من نصب واحتيال وابتزاز وتهديد وتحرش وقلق، إلى آخره، من قبل الأمن العام أو الكفيل أو السمسار. أو جميعهم معاً.

جمعت «أخبار الساحة» عدداً من شهادات اللاجئين/ات، عمّا عانوه خلال محاولتهم/ن الحصول على إقامة.

شهادة 1 | لاجئة في صيدا

لجأت إلى لبنان منذ خمس سنوات. كانت إقامتي «كفالة شخصية» من قبل أحد أقارب زوجي، لكنني انفصلت عنه منذ سنتين، ولم أستطع تجديد إقامتي عبر الكفيل نفسه، فـ«كسرت اقامتي».

عندما صدر قرار التسوية، طلبت من جارتي اللبنانية أن تكفلني، استكملت الأوراق المطلوبة، ثم ذهبت إلى الأمن العام.

سألني الرائد عن سبب كسر الأوراق وتغيير الكفيل، فأخبرته أنني انفصلت عن زوجي، وأن الظرف لا يسمح باستمرار قريبه ككفيل لي. تغيّرت لهجته، أصبح أكثر لطفاً. قال لي «زوجك ما بيستاهلك، منيح تركتيه، أنا رح ساعدك تمشّي أوراقك بكل جهدي». شعرت بالريبة حينها لأن أوراقي كاملة، وقرار التسوية مفتوح، فما هو شكل المساعدة التي يعرضها عليّ؟

كتب رقمه على ورقة، أعطاني إياها وطلب مني الاتصال به في أي وقت أحتاج فيه إلى «الفضفضة»، وأن موعد استلام الإيصال هو بعد شهر من اليوم، لكن علينا أن نظل على تواصل.

اتصلت به بعد شهر، فعاتبني على عدم التواصل معه، ثم طلب مني القدوم «فوراً» كي أبصم وأستلم الإيصال. في المركز مشت الأمور بكل سلاسة، وعندما خرجت أرسل لي عبر «واتساب» أنه «يرغب بأن يكون صديقي، والداعم لي، وأنه شعر بالسعادة عندما رآني مرة أخرى، لأنني جميلة وأعجبه».

خفت كثيراً من رفض الإقامة في حال قمت بحظره، فأخبرته أن علاقتي به لا تصلح لتكون صداقة «أنت ضابط وأنا مراجعة». لكنّه استمرّ بإرسال الرسائل والتأكيد على أن «ما يحدث بيننا سيبقى بيننا فقط، لا تخافي».

على مدى 15 يوماً، كنت أردّ على رسائله باقتضاب، وخلال فترات متباعدة، إلى أن طلب مني أن نخرج سويةً. شعرت بالذعر، وأنني غير مستعدة لتحمّل هذا الضغط كلّه من أجل الإقامة، فتوقفت عن الإجابة على رسائله تماماً، وتواصلت مع مكتب الحماية التابع للأمم. أخبرتهم بما حدث، لكنهم لم يتعاونوا أبداً، حتى أن العاملة الاجتماعية في المركز قالت لي «غريب أن هذا حدث معك أنت بالذات».

عندما حان موعد استلام الإقامة، لم أجرؤ على الذهاب وحدي، اصطحبت والدي معي. كان الرائد فظاً جداً حينها، وطلب مني العودة بعد 10 أيام.

كل 10 أيام كانت تليها 10 أخرى، حتى سلّمني الإقامة بعد ثلاثة أشهر من المماطلة.

شهادة 2 | لاجئ في صور

لجأت إلى لبنان منذ سنة، بعدما استنفذت فرص تأجيل الخدمة العسكرية في سوريا. دخلت بورقة موعد من السفارة، ثم «كسرت إقامتي».

عندما علمت أن باب التسوية مفتوح، ذهبت إلى الأمن العام وأخبرتهم أنني أريد تسوية وضعي، فطلبوا مني إحضار كفيل لبناني وبعض الأوراق الأخرى.

لم أكن قد تعرّفت على لبناني يملك ما يكفلني بموجبه بعد، فاضطررت إلى البحث عن «سمسار». والسمسار هو شخص ندفع له مبلغاً يحدده هو، مقابل تعهده لدى الأمن العام أننا نعمل عنده بواحدة من المهن المسموح للسوريين بمزاولتها، وهي قليلة ومحددة بفئة معينة.

بعد شهر من البحث، وصلت إلى شخص لديه أرض زراعية، طلب مني 300 دولار، مقابل أن يكفلني على أنني عامل في أرضه، شرط أن أدفعها مقدماً.

أخبرني أن المسألة مضمونة، وأن جزءاً من هذا المبلغ يذهب كرشوة إلى موظفي الأمن العام كي تسير الأمور بشكل جيد، وجزء منه هو تكلفة المعاملة.

في تموز 2022، ذهبنا إلى الصرفند، حصلنا على إفادة سكن من المختار، وتعهد مسؤولية لدى كاتب العدل، ثم قدمنا الأوراق إلى الأمن العام. تفاجأت هناك أنه عليّ دفع تكلفة المعاملة بنفسي (مليون و700 ألف ليرة لبنانية)، وأنني لن أستلم الإقامة في اليوم نفسه، كما أخبرني السمسار.

 ما سأحصل عليه هو إيصال يثبت أنني دفعت الغرامة المترتبة عليّ، وأنني تقدّمت بالطلب الذي تأتي الإجابة عليه بعد شهر بالرفض أو القبول.

راجعتهم بعد شهر، فأخبروني أن الطلب مرفوض، لأن الأرض التي قدّمت الطلب على أساس العمل فيها لا تحقق الشروط المطلوبة من ناحية المساحة.

بالطبع، لم أستطع استعادة المبلغ الذي دفعته للسمسار، فاضطررت إلى الانتظار شهرين كي أتمكن من تجميع المبلغ من جديد. عاودت تقديم الأوراق وحدي هذه المرة على أنني «عامل بناء» واشترطت على السمسار أنني لن أدفع ليرة واحدة حتى أستلم الإقامة.

في تشرين الأول 2022، تقدّمت بطلب جديد، وحصلت على إيصال جديد. أخبرني السمسار أنه عليّ دفع 50 دولاراً تكلفة أوراق قام هو باستخراجها وأنه سيحتاجها عند تجديد الإقامة في العام المقبل.

في البداية، رفضت دفع المبلغ، ثم خفت من أن يقوم بالتبليغ عني، فدفعت له من دون أن أعرف ما هي تلك الأوراق.

راجعت الأمن العام في مطلع تشرين الثاني، أي بعد شهر من تقديم الطلب، استلمت إقامتي ودفعت للسمسار 300 دولار جديدة.


 The racist Kafala system exposes Syrians to exploitation (1)

The Kafala (sponsorship) system puts the Syrian refugees, along with their efforts to legalise their presence on Lebanese land, in a dreadful cycle of exploitation and humiliation.  There is no limit to what they can face from fraud, extortion, threats, harassment, anxiety, etc,  whenever they try to settle their situation, all inflicted by the General Security, the sponsor, the broker or all of them together.

“Akhbar AlSaha” collected a number of testimonies  from refugees professing their suffering while trying to obtain a residency permit.

Testimony 1 |  A refugee in Saida

 I took refuge in Lebanon five years ago.  My residency was based on a “personal sponsorship” by one of my husband’s relatives, from which I separated two years ago. I was unable to  renew my residency permit through the same kafeel (sponsor), so I “broke my papers.”

 When the settlement decision was issued, I asked my Lebanese neighbour to sponsor me, I completed the required papers, and then went to the General Security.

The frontier asked me about the reasons my  papers were broken and why my sponsor was someone different. I told him that I had separated from my husband, and that the circumstances did not allow his relative to continue sponsoring me.  His tone changed, he became nicer.  He told me, “Your husband does not deserve you. It is good that you left him. I will help you deal with your papers with my full potential .”  I felt suspicious at the time, because my papers are complete, and the settlement decision is already done, but what is the kind of assistance that he is offering me?

 He wrote his number down on a piece of paper and handed it to me asking me to call him any time I needed to “vent”. He said that the date for getting the receipt is in a month from that day, and that we have to stay in touch.

I called him a month later, and he admonished me for not contacting him, then asked me to come “immediately”  so he could take my prints and hand me the receipt .  At the centre, things went smoothly, but when I got out, he texted me via WhatsApp that he “wants to be my friend, and my supporter, and that he felt content when he saw me again, because I am beautiful and he likes me.”

I was horrified by the idea that my residency permit might be rejected if I blocked him, so I told him that my relation with him was not fit to be a friendship, “You are an officer and I am a reviewer.”  But he proceeded in  sending me messages, assuring me that “what’s going on between us will remain between us only, do not be scared.”

For 15 days, I responded to his messages curtly, and infrequently, until he asked me to go out.  I panicked,  I wasn’t ready to take all this pressure for a residency permit, so I stopped answering his messages altogether, and contacted the UN Protection Office.  I told them what happened, but they never cooperated. The social worker at the centre even told me, “It’s strange that this happened to you in particular.”

When it was time to receive the permit, I didn’t dare to go alone. I took my father with me. The frontier was very rude at the time, and told me to come back in 10 days.

Every 10 days were followed by another 10, until he finally handed me the residency, after three months of procrastination.

Testimony 2 |  a refugee in Sour

 I took refuge in Lebanon a year ago, after using up all the chances to postpone my military service in Syria.  I came in with an appointment paper from the embassy, ​​and then “broke my residency.”

When I knew that the door to settlement was open, I went to the General Security and told them that I wanted to settle my situation, so they asked me to bring a Lebanese kafeel (sponsor) and some other papers.

I had not yet met a Lebanese person that had the means to sponsor me, so I had to look for a “broker”.  A broker is a person to whom we pay an amount of money, determined by him, in return for his pledge to the General Security that we work for him in one of the professions that Syrians are allowed to practice, which are few and limited to a specific category.

After a month of searching, I reached a person who owns a farming land. He asked me for 300 dollars, in return for sponsoring me as a worker in his land, if and only if I pay him in advance.

He told me that the matter is guaranteed, and that part of this amount goes as a bribe to the General Security staff in order for things to go well, and part of it is the cost of the transaction.

In July 2022, we went to Sarafand, obtained a proof of residency from the mayor, and a liability pledge from the notary, then we submitted the papers to the General Security.  There, I was surprised by the fact that I had to pay the cost of the transaction myself (one million and 700 thousand Lebanese pounds), and that I would not receive the residency permit on the same day, as to what the broker had told me.  

What I will get is a receipt proving that I have paid the fine incurred, and that I have submitted the application, which will be answered in a month with either rejection or acceptance.

I went back a month later, and they told me that my application was rejected, because the land that I submitted the application for, on the basis of working in it, did not meet the required conditions in terms of area.

 Of course, I could not recover the amount that I paid to the broker, so I had to wait two more months to be able to collect the quantity again.  I resubmitted the papers alone this time as a “construction worker” and stipulated to the broker that I would not pay a single pound until I received the residency permit.

In October 2022, I re-applied and got a new receipt.  The broker told me that I have to pay 50 dollars for the papers that he extracted and that he will need them when he renews my residency permit next year.

 At first, I refused to pay the amount, then I was afraid that he would report me, so I paid him without even knowing what those papers were.

I went to the General Security in early November, a month after submitting the application. I received my residency permit and paid the broker $300 dollars.
